These Terms of Service govern your access to and use of the ChatDeck website, browser extension, software, and related services.

These Terms of Service ("Terms") form an agreement between you and the operator of ChatDeck regarding your use of the ChatDeck website, browser extension, software, features, and related services (collectively, the "Services").

By installing, accessing, purchasing, or using ChatDeck, you agree to these Terms and our Privacy Policy.

1. Acceptance of Terms

By accessing or using ChatDeck, you confirm that you have read, understood, and agree to be bound by these Terms.

If you do not agree to these Terms, you must not use the Services.

2. The ChatDeck Service

ChatDeck provides productivity tools designed to enhance and organize supported ChatGPT workflows. Features may include conversation organization, search, saved prompts, saved responses, filtering, workspace controls, interface enhancements, and other related functionality.

Features may change over time as ChatDeck is developed and improved. Certain features may be available only through ChatDeck Pro or another paid offering.

ChatDeck is an independent product and is not affiliated with, endorsed by, sponsored by, or operated by OpenAI unless expressly stated otherwise.

3. Eligibility

You must be legally capable of entering into a binding agreement in your jurisdiction to use the Services.

If you use ChatDeck on behalf of a company, organization, or other legal entity, you represent that you have authority to bind that entity to these Terms.

4. License to Use ChatDeck

Subject to these Terms, ChatDeck grants you a limited, personal, non-exclusive, non-transferable, and revocable license to install and use the Services for their intended purpose.

Purchasing ChatDeck Pro gives you the right to use the Pro features associated with your purchase. It does not transfer ownership of ChatDeck, its software, source code, trademarks, designs, or other intellectual property to you.

Unless expressly permitted, you may not resell, sublicense, distribute, commercially exploit, or make ChatDeck available to third parties as your own product or service.

5. Acceptable Use

You agree to use ChatDeck only for lawful purposes and in accordance with these Terms.

You may not:

  • Use ChatDeck to violate applicable laws, regulations, or third-party rights.
  • Attempt to gain unauthorized access to ChatDeck systems, servers, accounts, databases, or infrastructure.
  • Circumvent licensing, payment, authentication, rate limiting, or access-control mechanisms.
  • Use automated methods to abuse, overload, disrupt, scrape, attack, or interfere with the Services.
  • Introduce malware, malicious code, viruses, exploits, or other harmful software.
  • Use ChatDeck to facilitate fraud, phishing, credential theft, unauthorized surveillance, or other harmful activities.
  • Reverse engineer or attempt to extract proprietary source code except where such restrictions are prohibited by applicable law.
  • Remove or alter proprietary notices, branding, copyright notices, or attribution contained in the Services.
  • Misrepresent your affiliation with ChatDeck or impersonate ChatDeck personnel.

6. Your Content

You retain your rights to prompts, responses, saved content, conversation information, and other content that belongs to you and that you use with ChatDeck.

You are responsible for ensuring that your use of content through ChatDeck complies with applicable laws, contractual obligations, intellectual-property rights, and the terms of third-party services you use.

ChatDeck does not claim ownership of your ChatGPT conversations or other user-generated content merely because the extension processes that content to provide requested functionality.

7. Payments and ChatDeck Pro

ChatDeck may offer paid features under the ChatDeck Pro plan. The price, payment method, and included features are displayed before purchase.

If ChatDeck Pro is advertised as a one-time purchase with lifetime access, "lifetime" means access for as long as the applicable ChatDeck product or service continues to be made available and supported. It does not guarantee that the Services will operate indefinitely.

We may introduce additional products, optional services, or separately priced features in the future. A previous purchase does not automatically entitle you to unrelated future products unless expressly stated.

8. Cryptocurrency Payments

ChatDeck may allow payment using supported cryptocurrencies or blockchain-based tokens.

You are responsible for selecting the correct blockchain network, token, payment amount, and receiving address shown during checkout.

  • Blockchain transactions may be irreversible once submitted.
  • Sending an unsupported token or using an incorrect network may result in permanent loss of funds.
  • You are responsible for transaction fees charged by the blockchain network or your wallet provider.
  • A payment may not be treated as complete until sufficient blockchain confirmation has been received.
  • Blockchain networks may experience congestion, outages, reorganizations, delays, or other technical events outside ChatDeck's control.

ChatDeck will never ask you to provide your seed phrase, recovery phrase, or wallet private key in order to complete a purchase.

9. Refunds

Unless required by applicable law or otherwise expressly stated at checkout, cryptocurrency purchases are generally final after successful payment confirmation and activation of the purchased service.

If you believe you made a duplicate payment, paid an incorrect amount, experienced a technical issue, or believe a refund is otherwise appropriate, contact us through the contact method provided on the ChatDeck website.

Refund requests are evaluated based on the circumstances of the transaction, technical feasibility, applicable law, and whether the associated purchase has already been delivered or used.

Any blockchain network fees incurred in sending or returning cryptocurrency may be non-refundable.

10. Third-Party Services

ChatDeck operates in connection with third-party services and technologies, which may include ChatGPT, web browsers, browser extension platforms, blockchain networks, wallets, infrastructure providers, and other services.

Your use of those third-party services is governed by their own terms and policies.

We are not responsible for outages, changes, restrictions, account actions, API changes, interface changes, or other conduct of third-party services that are outside our control.

A third-party platform may change its website or technical architecture in a way that temporarily affects ChatDeck functionality.

11. Service Availability

We aim to provide a reliable service but do not guarantee uninterrupted, error-free, or continuously available access.

ChatDeck may occasionally be unavailable because of maintenance, software updates, infrastructure failures, security incidents, third-party changes, network outages, or circumstances outside our reasonable control.

We may modify, update, suspend, replace, or discontinue features when reasonably necessary for product, technical, legal, security, or operational reasons.

12. Intellectual Property

ChatDeck and its software, branding, interface, designs, graphics, documentation, code, logos, and other original materials are owned by or licensed to the operator of ChatDeck and are protected by applicable intellectual-property laws.

Except for the limited license granted under these Terms, no ownership or intellectual-property rights are transferred to you.

Third-party names, trademarks, and products referenced through the Services remain the property of their respective owners.

13. Suspension and Termination

You may stop using ChatDeck at any time by uninstalling the extension and discontinuing use of the Services.

We may restrict or suspend access when reasonably necessary to protect ChatDeck, its users, infrastructure, or third parties, including in cases involving:

  • Material violations of these Terms.
  • Fraudulent or unauthorized payment activity.
  • Security threats or attempted compromise of the Services.
  • Abusive or disruptive automated activity.
  • Legal or regulatory requirements.

Where appropriate, we may provide notice or an opportunity to address the issue before terminating access.

14. Disclaimers

To the maximum extent permitted by applicable law, ChatDeck is provided on an "as is" and "as available" basis.

We disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, error-free operation, and any warranties arising from course of dealing or usage of trade, except where such disclaimers are prohibited by law.

ChatDeck does not guarantee that information displayed, organized, saved, processed, or exported through the Services will always be complete, accurate, or recoverable.

You are responsible for maintaining appropriate backups of information that is important to you.

15. Limitation of Liability

To the maximum extent permitted by applicable law, ChatDeck and its operator will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, revenue, data, business opportunity, goodwill, cryptocurrency, or digital assets arising from or related to your use of the Services.

To the maximum extent permitted by law, ChatDeck's total aggregate liability for claims arising from or relating to the Services will not exceed the amount you paid to ChatDeck for the applicable service during the twelve months preceding the event giving rise to the claim.

Some jurisdictions do not allow certain limitations or exclusions of liability, so some of these provisions may not apply to you.

16. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless ChatDeck and its operator from claims, liabilities, losses, and reasonable expenses arising from your unlawful use of the Services, material violation of these Terms, or violation of third-party rights.

17. Changes to the Service or Terms

We may update these Terms when ChatDeck changes or when legal, operational, technical, or security requirements change.

The updated Terms will be published on this page with a revised "Last updated" date.

If changes materially affect your rights or obligations, we may provide additional notice where reasonably appropriate or legally required.

Continued use of ChatDeck after updated Terms become effective constitutes acceptance of those Terms to the extent permitted by applicable law.

18. Governing Law

These Terms are governed by the laws applicable to the operator of ChatDeck, without regard to conflict-of-law principles, except where mandatory consumer-protection laws in your place of residence provide otherwise.

Nothing in these Terms removes rights that cannot legally be waived under applicable consumer-protection law.
